To ask the Scottish Government when the review of the Mental Health (Care and Treatment) Scotland) Act 2003 will begin, and who will be consulted.

The Scottish Government is currently working towards implementing the provisions of the Mental Health (Scotland) Act 2015. This contains several measures which strengthen the provisions in the Mental Health (Care and Treatment) (Scotland) Act 2003 that promote and protect service users’ rights. It also includes giving service users more control over their representation and strengthening the position of advance statements and advocacy which help service users express their will and preferences.

During the passage of the Mental Health (Scotland) Act 2015, the Scottish Government committed to undertake a review to determine whether the provisions of the 2003 Act fulfil the needs of people with learning disability and autism. A scoping exercise has been concluded and work is underway to appoint a Chairperson to lead this review. It will be for the Chairperson to decide on an engagement strategy which will include gathering evidence for the review in a variety of ways.

Alongside the review, there is also the ongoing work relating to Adults With Incapacity legislation. It would therefore be inappropriate to consider wider changes to mental health legislation until these pieces of work have concluded.
