Network Rail is responsible for maintaining and renewing the rail network across the UK including Scotland. While the Scottish Government fund Network Rail north of border, its operations are a reserved matter therefore any questions on employment issues would be for UK Ministers.

Our view remains that a fully devolved, public sector controlled and better integrated railway would deliver more for Scotland’s economy and communities. The UK government is more than aware of our position and, yet, the Williams-Shapps proposals not only ignore these requests, they add further complexity in terms of how GB/devolved operations will interface.

Despite these complexities, we are future proofing Scotland’s rail network through our Strategic Transport Projects Review 2 and our Rail Services Decarbonisation Action Plan. Our work to remove diesel services by 2035, through a mix of electrification and alternative powered trains, will create more skilled and sustainable jobs which can provide a significant contribution to our economy.

Restricting high value contracts to participation by suppliers based on their location would not be in keeping with the requirements of the Public Contracts (Scotland) Regulations 2015. However our public procurement policy and legislation has driven high levels of local business participation as well as investment in jobs, skills and subcontracting with Scottish SMEs.

The majority of chargers on the publicly funded ChargePlace Scotland network are owned by local authorities who are responsible for procurement of their charging infrastructure. Scottish ministers do not hold information on these contracts. These contracts are however covered by public procurement policy and legislation, this includes a requirement to consider how procurement processes can facilitate the involvement of SMEs, third sector bodies and supported business and how public procurement can be used to promote innovation.

There are no specific provisions in the Scottish Government Offers of Grant that require contracts to be awarded to one cohort of companies over another.

Grantees in the private sector or members of the public select a local installer from the Energy Saving Trust’s list of approved installers ( ). There is no cost for a business, including Scottish SMEs, to register to be added to this list, should they be interested in doing so.

This range of work provides opportunities for local businesses, including SMEs, to benefit from investment in development of the electric vehicle charge point network.

We want to encourage new, innovative, home-grown ideas to aid the decarbonisation of transport in Scotland and ensure Scottish businesses are positioned to deliver competitive solutions and services across the sector. We have provided £780,000 of funding to Scottish SMEs through the Can Do Innovation Challenge framework , supporting businesses to design and to build the commercial case for innovations related to electric vehicle charging.

To support business and economic development across Scotland we are supporting Scottish innovation across Technology Readiness Levels to enable existing and new Scottish companies, including SMEs, to secure a share of the Zero Emission transport market. We are also providing support for the stimulation of the Zero Emission Mobility technology market and stimulating technological innovation which will improve user experience and encourage further uptake of zero emission vehicles.

The sustainable procurement duty in the Procurement Reform (Scotland) Act 2014 requires public bodies to consider how their procurement activity can be used to contribute to social, economic and environmental well-being and to act in a way to secure this. To demonstrate progress and compliance, public bodies are required to outline in their Annual Procurement Strategy how procurement will deliver local environmental impacts and, report progress in their Annual Procurement Reports.

Scottish Government provides funding to a wide range of organisations to install electric vehicle charge points under Section 70 of the Transport (Scotland) Act 2001. The majority of funding to develop the ChargePlace Scotland electric vehicle charging network has been awarded to public bodies. Many local authorities and public bodies carry out procurement using frameworks established by organisations such as Scotland Excel. These frameworks are also covered by the Sustainable Procurement Duty and therefore consider the wider social, economic and environmental aims of procurement in a consistent manner as required by the sustainable procurement duty under the Act.

Grant funding awarded to other types of organisations would be to individuals or to small and medium-sized enterprises with a base in Scotland. There is no obligation for these organisations to comply with the Act.

The Scottish Government has invested over £50 million in development of the ChargePlace Scotland network. Funding is provided to all of Scotland’s local authorities to provide communities across Scotland with a robust user-focused charging network ensuring that no area is left behind. The majority of this investment has been through the Local Authority Install Programme, meaning that local authorities are responsible for the procurement of charge points and the associated warranty and maintenance packages.

Recent offers of grant for the Local Authority Install Programme include a requirement to embed the Place Principle in delivery, supporting the National Performance Framework’s collective purpose for Scotland. This establishes an expectation to plan and work with local communities and recognise the benefits of planning, investment and implementing activity at the regional level of place, where that focus could drive faster rates of sustainable and inclusive economic growth.

Many local authorities carry out procurement using frameworks established by organisations such as Scotland Excel. These frameworks are also covered by the Sustainable Procurement Duty and therefore consider the wider social, economic and environmental aims of procurement in a consistent manner as required by the sustainable procurement duty under the Act.

Whilst Scottish Ministers fund the operation of the ChargePlace Scotland public EV charging network, installation and maintenance of the infrastructure is the sole responsibility of the respective charge point owners. Funding has been provided to local authorities to support maintenance up to 2022.

To support development of a resilient and reliable national network, that in turn supports Scotland’s economic, environmental and social well-being, all grants for electric vehicle charging infrastructure include conditions requiring the grantee (charge point owner) to have a warranty & maintenance contract in place to ensure infrastructure remains in good working order.

To ensure ChargePlace Scotland is an inclusive network, suitable for all EV drivers across all areas of Scotland and to complement our existing ‘Common Requirements and Good Practice Guide for the ChargePlace Scotland Network’ , we are developing guidance documents to aid the planning and installation of charge points in areas with varied geographic and demographic characteristics, including rural and island communities and areas at the top of the Scottish Index of Multiple Deprivation.

We are also involved in the development of Accessible Electric Vehicle Chargepoint standards that will be applicable across the United Kingdom. Through Scottish Enterprise’s Can Do Innovation Challenge framework we have already contributed £390,000 to Scottish SMEs, supporting the development of innovative ideas to make charge points more accessible. Engaging the disabled community and stakeholder organisations throughout the process.

We are also working with Scottish Futures Trust to consider the most appropriate structures and approach to expanding public charging networks across Scotland. Ensuring a Just Transition will be embedded as a core principle so that no parts of Scotland are left behind.

In addition to our work on charging infrastructure we are continuing our support for decarbonisation of the Scottish bus fleet and have committed £120 million over the coming 5 years. The Scottish Zero Emission Bus Challenge Fund (ScotZEB) is designed to encourage the market to bring forward new and innovative ways to finance the transition to zero-emission bus fleets and will support Scotland’s green recovery, providing immediate economic stimulus and supporting the Scottish Government’s bold ambitions to decarbonise the bus fleet.

CMAL conducted an open tender process for delivery of the new vessels intended to service the Islay routes. Under procurement law, direct award of vessels to any shipyard is only permitted under limited circumstances. We have to approach the issue of direct award with care. We are looking at future contracts from public agencies and whether any might be legally open to direct awards. No decision has yet been taken regarding the direct award of future vessels to publicly owned shipyards or any other shipyard in Scotland and the rest of the UK.

Transport Scotland and CMAL fully understand the importance and significance of engaging with the relevant trade unions on ferry services and future vessel contracts. In relation to the Islay vessels project regular meetings were held with unions by Transport Scotland, CMAL and CalMac, from the outset of the project in January 2019. Similarly, these bodies have provided unions with progress updates on the development on the new Islay vessels, listening and taking action on their views when appropriate. A similar approach will be taken with all future projects.

The PricewaterhouseCoopers contract was awarded to provide recommendations for the National Care Service design authority programme management structure which will support the proposals for community health and social care outlined in the National Care Service consultation.

The contract was awarded on 2 September 2021 in accordance with the Crown Commercial Services (CCS) Management Consultancy Framework 2 (RM6008) terms with the Contract Award Notice.

The Scottish Government is currently consulting on proposals for the National Care Service to ensure a wide range of views are heard and understood. Co-design with people using services and delivering services is a foundational principle in the National Care Service programme. The scope of external involvement is for the setup of the Design Authority programme management structure which will support the introduction of a National Care Service pending the outcome of consultation responses.

Additional external expertise and specialisms are required to ensure safe and robust governance for programme development. Ensuring our design processes are robust, take account of the views of people, promote system clarity and improved outcomes for people is paramount. Having external expertise to support major transformation is essential to ensure robust design process.

The Framework represents a range of skills required for major transformation programme support including programme management and governance setup as opposed to social care delivery experience. The Framework was established specifically in recognition of the need for such services on an occasional basis and is available for use by all UK public bodies. It sought to address the understandable lack of such specialist internal resources due to the temporary nature of such a requirement. Calling off from the Framework provides access to a range of skill sets, and levels and areas of specialism drawn from a team of resources as opposed to reliance on single individuals.
