As set out at Section 2.38 of the Ministerial code Ministers must not divulge either who provided the advice or its contents (whether it is from the Law Officers or from anyone else). This applies to all forms of legal advice, including advice on a particular subject or advice associated with clearance of a document.

To enable Ministers to reach a decision on the next steps for the Deposit Return Scheme, a number of discussions were held with those involved in the scheme in the weeks prior to the announcement including Circularity Scotland and business groups. The First Minister then met with Circularity Scotland on 20 April 2023.

The Scottish Government will consult on the next Climate Change Plan, a draft of which will be published in November 2023. Plans for consultation are still in development.

The Scottish Government is committed to building resilience to the impacts of climate change as part of Scotland's just transition to a net-zero economy and society.

Alongside continuing to deliver over 170 policies and proposals in the current Scottish Climate Change Adaptation Programme, the Scottish Government is also now developing the next programme. Public consultation is anticipated for the start of 2024 with the aim of publishing a final statutory programme in Autumn 2024.

This third five-year Adaptation Programme will respond to the full range of current and future climate risks for Scotland, as independently identified by the Climate Change Committee in its evidence base for the UK Climate Change Risk Assessment 2022. The Scottish Government is also looking for additional, early actions we can take to address the highest priority risk areas identified by the Climate Change Committee.

While progress is being made, we acknowledge that more needs to be done. Adaptation to the locked in impacts of climate change is a global challenge and we are not alone in needing to accelerate progress.

The Scottish Government has promised a laser like focus on delivery, and we will ensure this happens, by directing energy and resources towards achieving the three missions and supporting the outcomes set out in Equality, opportunity, community: New leadership - A fresh start . Our ambition for an improving, consistent and transparent focus on performance and delivery is shared by Ministers and the Executive Team.

Published in 2020, the Climate Emergency Skills Action Plan (CESAP) provides a framework for green skills planning and investment across priority sectors that will be critical to the transition to net zero: Energy, Construction, Transport, Manufacturing and Agriculture and land-use.

Skills Development Scotland and the Scottish Funding Council are progressing Pathfinder projects to identify the skills requirements necessary to support the priority sectors identified in CESAP including in heat decarbonisation. The Pathfinders are operating in Glasgow City and Shetland Islands and the findings will strengthen the green skills evidence base and inform further action to address green skills gaps.

Other examples of work in the energy sector include the development of an Energy Skills Passport, to support workers as we move towards the just transition. Additionally, the upcoming Onshore Wind Sector Deal, which will enable the delivery of 20GW of installed onshore wind by 2030, will have a specific theme on Skills, Supply Chain and Circular Economy.

On behalf of the Scottish Government, Skills Development Scotland work with Industry Leadership Groups and other key industry players to develop Regional and Sector Skills Investment Plans. They are created through a process of labour market and skills supply research and analysis, industry consultation and action planning with industry and partners across Scotland’s education and skills system.

In 2023-24 local authorities will receive funding through the local government finance settlement of nearly £13.5 billion. Local authorities also have a range of revenue raising powers that are not available to other public services.

The Scottish Government’s policy towards local authorities’ spending is to allow local authorities the financial freedom to operate independently. As such, the vast majority of funding is provided by means of the block grant. It is then the responsibility of individual local authorities to manage their own budgets and to allocate the total financial resources available to them, on the basis of local needs and priorities, including with regards to climate adaptation, to having first fulfilled their statutory obligations and the jointly agreed set of national and local priorities.

While local authorities are responsible for setting their own budgets, the total funding provided by the Scottish Government will increase by over £793 million in 2023-24 compared with the 2022-23 budget. Decisions on budget allocations for future years are subject to negotiation with COSLA and the results will be confirmed as part of future Scottish Budgets.

By way of example £42 million is provided to local authorities annually for flood risk management, with an additional £150 million announced for investment over this Parliament. Additionally, £11.7 million for coastal change adaptation is available to support coastal local authorities over the course of this Parliament.
