I have asked Teresa Medhurst, Chief Executive of the Scottish Prison Service (SPS), to respond. Her response is as follows:

The health and wellbeing of those who live and work in our prisons is a key priority for the Scottish Prison Service and we continue to work with numerous organisations to offer those in their care a suite of support to address both their addiction and recovery journey.

1. Current reporting incident categories do not align with the above question and make it impossible to answer. SPS do however record instances of those in our care who are believed to be under the influence of substances.

SPS are reviewing reporting processes that should allow this information to be captured in a more robust and accurate manner.

2. Staff are advised in line with Staff Notice 053/17 to follow procedures if they believe they have been exposed to an unknown substance, this includes recording of the incident by way of an Accident at Work.

With regards to the recording of medical attention, NHS are responsible for the release of this information due to patient confidentiality; and in the case of SPS staff members, SPS will record accidents at work, however, it is at the individual’s discretion if they chose to report such incidents, despite advice and guidance detailed in staff notice 053/17.

HMP Glasgow will deliver safe and secure accommodation, with maximum possible benefit and opportunity to those who live and work there, as well as the surrounding communities. The new prison will provide a better quality of living environment and enable strong relationships with staff and those in the care of the Scottish Prison Service.

The final design will be concluded in summer 2024, prior to the planned award of the construction contract that is scheduled for autumn 2024. Until the construction contract is signed, time-scales cannot be confirmed.

A wide range of criminal laws relate to image-based sexual abuse, including legislation concerning indecent images of children and the offence of coercing a person to view a sexual image. It is also a criminal offence to share intimate images without consent.

In schools, pupils also learn how to conduct online relationships safely and to understand the risks and consequences of sharing intimate images. Our Gender Based Violence in School Guidance published this week, makes clear that this includes the non-consensual sharing of sexual images and the threat of it.

In addition we fund Education Scotland to coordinate the Mentors in Violence Prevention programme, focussed on challenging attitudes underpinning gender-based violence, and support schools to access Rape Crisis Scotland’s National Sexual Violence Prevention programme.

It is well established that some occupations are restricted by capacity and age due to the physical demands of those roles, making it untenable to expect them to be carried out until the State Pension Age. This was recognised by the Public Service Pensions Act 2013 which set a pension age of 60 for firefighters, police officers and the armed forces.

Prison officers do not have a dedicated pension scheme as they are members of the Civil Service pension scheme, which is a reserved matter for the UK Government. We recognise that prison officers carry out frontline operational duties, including control and restraint, until the State Pension Age, which is due to rise to age 68. This can be particularly challenging and carries with it significant stresses and strains. We have previously raised the concerns around physical demands of prison officers role with the UK Government.

Scottish Prison Service do not assess age to determine whether a prison officer is capable of carrying out their duties but recognises that front line staff work in a very challenging environment. SPS has arrangements in place to support staff who may no longer be able to fulfil the physical demands of their role and these cases are managed in accordance with the circumstances of each individual.

The Scottish Government has raised concerns with the UK government regarding the requirement for prison officers to carry out frontline operational duties including control and restraint until the age of 68. We have always accepted that some jobs are restricted by capacity and age, and need to be viewed and treated as such.

The Scottish Government and SPS both duly recognise that prison officers work in a very challenging environment and are committed to a person centred approach to all employees and their circumstances.

In collaboration with the Scottish Prison Service (SPS), and other key justice organisations, we are taking action to tackle the rising prison population.

Prison will always be necessary for those who pose a risk of harm or threaten the delivery of justice. Equally, the Scottish Government is committed to shifting the balance between the use of custody and justice in the community. The budget for 2024-25 includes an additional £14m in support for community justice services and ongoing work to further enable a shift away from the use of custody, bringing the total to £148m. This will support work to strengthen alternatives to remand and the provision of community sentences and interventions, which we know can be more effective in reducing reoffending and assisting with rehabilitation than short-term custodial sentences, leading to fewer victims and safer communities.

To date we have taken action such as the extension of the presumption against short sentences from three months or less to twelve months or less, to enable a further shift away from short custodial sentences, and introduced the use of electronic monitoring on bail. We have established a Prison Population Leadership Group, engaging a range of Justice partners, to further consider the challenges and mitigations associated with the rising prison population.

SPS is taking forward action to respond to the pressures caused by the rising prison population and remains committed to prioritising the health and wellbeing of staff and those living in prison. It is keeping its current population management strategy under review in order to accommodate the rising prisoner numbers. It is also taking forward a range of proposals to optimise the current prison estate which has already seen the transfer of male prisoners into accommodation previously housing women at HMP Edinburgh and the transfer of robustly risk assessed adult male prisoners to HMP&YOI Polmont.

The Scottish Government and the Scottish Prison Service (SPS) recognise the impact of illicit drugs in prisons and the importance of supporting prisoners on their recovery journey.

We are committed to ensuring that the prison population have access to healthcare that is, as a minimum, equal to that offered in the community. A recent example is the development of a prisoner Healthcare Target Operating Model to provide a framework for nationally consistent healthcare delivery including the future state of addictions services. The National Prison Care Network are visiting NHS Boards to support the implementation of this model.

There are already a range of innovative projects in prisons including recovery cafes, recovery walks, mutual aid groups and other positive diversionary activities. Partnership working is crucial and the SPS works with several third sector organisations to deliver consistent recovery pathways to help individuals reintegrate back into communities. The multi-disciplinary Recovery Network also provides the SPS with an opportunity to share and replicate best practice in the community.

Medication Assisted Treatment standards are a key component of our National Drugs Mission and the SPS have committed to embed these standards across the prison estate. It is working with NHS Partners to ensure healthcare choice aligns with community-based treatment services wherever possible. In addition, the Prison to Rehab Protocol supports individuals to access abstinence-based treatment on release and sets out the process for prison staff, service providers and individuals on accessing the pathway.

All this work directly links to the Scottish Government’s National Mission. However, enforcement is also important, and a variety of operational and technological responses are deployed to prevent substances entering the prison estate. These include body scanners and Rapiscan machines, which detect substances that may be concealed in items of mail and personal property.

The health and wellbeing of those who live and work in our prisons is a key priority for the Scottish Prison Service.

Investment in technologies such as Rapiscan machines, now available in every prison, and the recent purchase of 9 new Body Scanners, further enhance a comprehensive range of security measures already deployed by the SPS to detect illegal substances. We are also piloting Drone Detection technology to help detect and prevent the introduction of illicit articles and substances through this channel.

By working closely with partners such as Police Scotland, SPS must and does remain vigilant to the continuously evolving nature of drug use to ensure use of technology and tactical measures remain current, adaptable, and capable of detecting and preventing drugs from entering our prisons.

SPS will continue to work with partners to prevent the introduction of contraband and seek convictions where appropriate.

SPS also continue to advise staff on safety and risk assessment processes in conducting their duties, to minimise the impact and risk of exposure to any unknown hazardous substance.
