Economy and Fair Work Committee

Subordinate Legislation

Meeting date: 5 March 2025

Murdo Fraser

I appreciate that we have the review in a year, but the code is coming into effect on 31 March, which is only three weeks from now, so we are very much in the 11th hour in that regard.

A few concerns have been raised with us by the Scottish Beer & Pub Association, which, as you know, represents landlords. One of its concerns is about the number of pub companies and tenants who are unaware of the code, which is coming into effect in just a few weeks. The association says that both the Scottish Government and the Scottish pubs code adjudicator have not been able to identify all impacted businesses, and it is unlikely that that will be done before 31 March. What is the Scottish Government doing to address the issue of people not being aware that the code is coming in?

The adjudicator is currently funded by the Scottish Government, is that right?

However, there is no particular reason why that could not happen, is there?

That was a very clear answer. Do you have any views on the criteria for establishing new commissioners, including on whether those have been properly followed in the past or whether they need to be adjusted?

With regard to the relationship between your office and the Scottish Human Rights Commission, your office existed first and the Human Rights Commission came later. If we had already had a human rights commission, would we still have needed a children鈥檚 commissioner?

Thank you for those answers. Just so that I and other members are clear, are you telling me that you could incorporate those roles but it would require your mandate being looked at? Are you telling me that, as it stands, you do not believe that the Scottish Human Rights Commission properly represents the views of disabled or older people?

That is helpful, because I think that I now understand. In effect, you are telling me that the issue is capacity rather than powers. Is that correct?

Good morning, and welcome. The mandate that we have been given by the Finance and Public Administration Committee is to look at two broad areas. One is whether there are any gaps or overlaps in the work of existing commissioners. The other is the proposals that are in the pipeline, which you will be aware of, to create new commissioners.

I would like to explore those issues together, because there is obvious synergy between them. We have proposals in the pipeline for a commissioner for the disabled and a commissioner for older people, and we already have the Children and Young People鈥檚 Commissioner Scotland. Is there any reason why the work that you are doing cannot encompass the work that is proposed to be done or that is already being done for sectional groups, as they might be called?
