I think that we should keep the petition open. The Scottish Government鈥檚 position is not clear to me, as it is still consulting on these issues. As the petitioner pointed out, we have had strong commitments in the past that have not materialised into action. It would therefore be premature to close the petition until we have a clear position from the Government and an outcome from the consultations.

Good morning.

Going back to the discussion around the original 3-mile limit and the references to the Cameron report, is it fair to say that its conclusion that the original limit could not be justified on conservation grounds did not take an ecosystems-based approach and did not factor in the impact on the sea bed and related species? Is it also the case that research and evidence in this area have moved on and that we now have a greater understanding of the importance of ecosystems management?

Shark Fins Bill

The minister mentioned that the bill will prevent the import of shark fins. Does she have any further information about fins being used as part of other products鈥攆or example, they might be ground up and incorporated into other products鈥攐r on whether there has been any research into the impact of the ban on importing such products, how widespread the practice is and how common shark fin importing is?

On amendments 175 to 179, in the name of the minister, I am not persuaded by her remarks, but I appreciate her commitment to sharing further information ahead of stage 3鈥攁lthough I am not sure whether it is being shared with me or with the whole committee. On that basis, I ask the minister not to press amendment 175 or to move the other amendments, so that we can vote on them when we have a full explanation in front of us. However, if she seeks to do so, I ask members not to support the amendments.

I, too, have a couple of questions relating to those amendments.

Amendment 175 would empower a constable to stop and search without a warrant. Will you outline whether such a power is typically provided for in Scottish Government legislation? Is it quite a standard power or is it exceptional? What has led you to make that decision? At first glance, it seems as though it could be a little heavy handed and open to being exploited.

I am grateful to Christine Grahame for lodging amendment 174, because it strengthens section 11 of the bill by placing a greater responsibility on those following scents. Therefore, I will not support amendment 174A, in the name of Rachael Hamilton, which would narrow the scope of amendment 174. Nor will I support amendments 237 or 238, in the name of Rachael Hamilton, because I am concerned that they could create a loophole for trail hunting.
